1:1 Grief Support Session Policies

Please read carefully.

By paying the invoiced amount, you agree with the terms and conditions specified in the Grief Support Agreement and below.

These Session Policies govern your participation in 1:1 grief support sessions with Nadjalisse Rodriguez Rolon (also referred to as "Nina Rodriguez" or "Grief Guide"). By signing up for any 1:1 grief support offering through griefandlight.com or affiliated sites, you ("Client" or "you") agree to be bound by these policies. Please read them carefully before proceeding.

Description of Grief Support:

 

Grief support or grief guidance is a collaborative relationship (defined as an alliance, not a legal business partnership) between the Grief Guide and the Client, aimed at providing emotional support, reflective space, and compassionate guidance as the Client navigates their grief journey. This process is intended to foster self-awareness, resilience, and healing by exploring emotions, identifying personal needs, and integrating loss into daily life. The Grief Guide offers a supportive presence, resources, and practices to help the Client process their grief in a way that aligns with their unique experience and values. Grief support is not therapy, counseling, or medical treatment and does not diagnose or treat mental health conditions. 

1) Grief Guide-Client Relationship

(a) The Client is solely responsible for their own emotional, mental, and physical well-being, as well as their decisions, choices, actions, and outcomes arising from their grief support relationship and interactions with the Grief Guide. The Client acknowledges that the Grief Guide’s role is to provide compassionate support, reflective space, and tools to navigate grief, but not to diagnose, treat, or provide medical, psychological, or therapeutic services. The Client agrees that the Grief Guide is not and will not be liable for any actions or inaction, nor for any direct or indirect results of the grief support provided. The Client understands that grief support is not therapy, counseling, or a substitute for professional mental health care.

 

(b) The Client acknowledges that grief support is a holistic process that may touch on various aspects of their life, including emotional well-being, relationships, spirituality, work, health, personal growth, and daily routines. The Client understands that it is their sole responsibility to determine how to integrate grief support insights into these areas and to make and implement their own choices.

(c) The Client acknowledges that grief support does not involve the diagnosis or treatment of mental health conditions and is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional services provided by licensed legal, medical, or mental health professionals. It is the Client’s sole responsibility to seek independent professional guidance as needed. If the Client is currently receiving care from a mental health professional, it is recommended that they inform their provider about their participation in grief support sessions. The Grief Guide does not provide medical, psychological, or legal advice and does not assume responsibility for the Client’s mental health needs.

 

(d) The Client understands that to benefit from the grief support relationship, they agree to communicate honestly, remain open to feedback and guidance, and dedicate the necessary time and energy to engage fully in the grief support process. The Client acknowledges that their progress is dependent on their own willingness to explore their grief, implement suggested practices, and take an active role in their healing journey.

2) Services 

(a) The parties agree to engage in a grief support process through virtual calls, with the number and frequency of sessions based on the specific package selected by the Client. The frequency of sessions will be determined jointly between the Grief Guide and the Client, considering both the Client’s needs and the Grief Guide’s availability. The Grief Guide will initiate all scheduled calls.

 

The Client has up to one (1) year from the date of this Agreement to schedule and participate in their sessions. The Client may choose to schedule sessions at their own pace, with a maximum of three (3) scheduled virtual calls per month. Any sessions not completed within the one-year period will be considered forfeited, and no refunds will be issued for any unused sessions, except as provided in the Termination clause.

(b) Availability Between Sessions: The Grief Guide will be available to the Client between sessions for urgent matters only, which may include time-sensitive questions related to scheduling or logistics, or technical issues (such as problems with the platform or accessing session materials), and do not include requests for ongoing support, emotional support, or substantive questions related to grief processing. Support for these matters will be provided via email or the online community. This availability is Monday through Friday, excluding national holidays and the Grief Guide's vacation periods. The Grief Guide will make reasonable efforts to respond promptly, typically within 48 hours. Non-urgent inquiries or requests for ongoing support should be addressed during scheduled sessions to ensure the most productive use of time.

3) Fees 

The Client agrees to pay the agreed-upon fee for grief support services as outlined in the selected package. Payment is due in full upon signing this Agreement and must be received before the first scheduled session.

The Client acknowledges that all payments are non-refundable after fourteen (14) calendar days from the date of payment, regardless of whether the Client schedules or completes all sessions within the one-year period specified in this Agreement, except as provided in the Termination clause.

4) Confidentiality 

All information provided by the Client to the Grief Guide during the course of the grief support relationship will be considered "Confidential Information" and kept strictly confidential, unless otherwise agreed in writing. The Grief Guide will not disclose any communications, whether verbal or written, that take place between the Client and Grief Guide or regarding this Agreement, without the Client's prior written consent. THE CLIENT AGREES THAT ALL SESSIONS AND COMMUNICATIONS ARE STRICTLY CONFIDENTIAL AND MAY NOT BE SHARED, OR USED FOR ANY PURPOSE OUTSIDE OF THE SCOPE OF THIS AGREEMENT, WHETHER PUBLICLY OR PRIVATELY, WITHOUT THE EXPRESS WRITTEN CONSENT OF THE GRIEF GUIDE. FAILURE TO COMPLY WITH THIS PROVISION SHALL CONSTITUTE A MATERIAL BREACH OF THIS AGREEMENT.

This confidentiality requirement also extends to any testimonials, which the Grief Guide may use for promotional purposes only with the Client's explicit consent. The Client may request anonymity in connection with any testimonials that are used.

Confidential Information does not include information that:


(a) was in the Grief Guide’s possession prior to being provided by the Client;
(b) is generally known to the public or within the Client’s industry;
(c) is obtained by the Grief Guide from a third party without breach of any confidentiality obligation to the Client;
(d) is independently developed by the Grief Guide without the use or reference to the Client’s confidential information;
(e) is required to be disclosed by statute, lawfully issued subpoena, or court order;
(f) involves an imminent risk of harm to the Client or others, where disclosure is necessary for safety; or
(g) involves illegal activity.

The Client also acknowledges a continuing obligation to raise any confidentiality concerns or questions with the Grief Guide in a timely manner.

While the Grief Guide is committed to maintaining confidentiality, the Grief Guide-Client relationship is not legally recognized as a "privileged" relationship in the same way as medical or legal professions. Thus, communications are not automatically protected by any recognized legal privilege.

5) Cancellation & Rescheduling Policy

 

Each session can be rescheduled once at no additional charge, provided that the Client notifies the Grief Guide at least 48 hours in advance in writing if they need to cancel or reschedule a scheduled session. If the Client fails to provide timely notice, the Grief Guide reserves the right to bill the Client for the missed session. The Grief Guide will attempt in good faith to reschedule the missed session within the allowed time frame, but it will be considered forfeited if not rescheduled or completed within the one-year period.

 

6) Termination 

 

Either party may terminate this Agreement by providing written notice to the other party at least fourteen (14) days prior to the intended date of termination. Upon termination, the Client remains obligated to compensate the Grief Guide for all grief support services rendered up to and including the effective date of termination, in accordance with the agreed-upon fee schedule. 

 

(a) Termination by Client within the 14-Day Refund Period: If the Client terminates this Agreement within fourteen (14) days of the date of initial payment, the Client will receive a refund for any unused sessions, less the value of any services already rendered and any reasonable transaction fees. 

(b) Termination by Client after the 14-Day Refund Period: If the Client terminates this Agreement after fourteen (14) days from the date of initial payment, no refund will be issued for any unused sessions. 

(c) Termination by Grief Guide: If the Grief Guide terminates this Agreement, the Client will receive a pro-rated refund for all unused, pre-paid sessions, less any transaction fees.

(d) Survival of Certain Provisions: The provisions regarding confidentiality, limited liability,  dispute resolution, severability, waiver, and entire agreement shall survive the termination of this Agreement.

7) Limited Liability 

Except as expressly set forth in this Agreement, the Grief Guide makes no representations, warranties, or guarantees, express or implied, regarding the effectiveness, outcomes, or results of the grief support services provided. The Grief Guide does not guarantee any specific results or success from the grief support services. The Grief Guide is providing a service, and results may vary. In no event shall the Grief Guide be liable to the Client for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with this Agreement or the grief support services provided.

Notwithstanding any damages the Client may incur, the Grief Guide's total liability under this Agreement, including for any claims related to breach of contract or otherwise, shall be limited to the amount paid by the Client to the Grief Guide for the services rendered up to and including the date of termination of the coaching relationship, minus any applicable processing fees. This limitation of liability shall apply regardless of the cause of action, whether in contract, tort, or otherwise.

8) Entire Agreement 

This Agreement represents the entire understanding between the Grief Guide and the Client concerning the grief support services to be provided and supersedes any and all prior discussions, representations, agreements (oral or written), or understandings, whether expressed or implied, between the parties. No modification, amendment, or supplement to this Agreement will be valid or enforceable unless made in writing and executed by both the Grief Guide and the Client. Any amendments shall become effective only upon mutual agreement and signature of both parties, and no course of conduct or course of dealing shall alter the terms of this Agreement. 

9) Dispute Resolution 

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice given. The mediation will take place in a location and manner agreed upon by the Grief Guide. If the dispute remains unresolved after the mediation period, either party may pursue legal action. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover reasonable attorney’s fees and court costs from the other party, but only for fees and costs incurred after the unsuccessful mediation. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action arising out of or relating to this Agreement shall be filed exclusively in the courts of Miami-Dade County, Florida.

10) Severability 

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable for any reason, the remainder of the Agreement shall remain in full force and effect. In the event that a court finds any provision of this Agreement invalid or unenforceable but determines that limiting the scope of such provision would render it valid and enforceable, the provision shall be deemed modified to the extent necessary to make it valid and enforceable, and the Agreement shall be construed and enforced accordingly.

11) Waiver 

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver of that party's right to enforce such provision in the future, nor shall it affect the right to enforce any other provision of this Agreement. A waiver of any provision of this Agreement must be in writing and signed by the party granting the waiver to be effective.

12) Binding Effect 

This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors, heirs, and permitted assigns. Neither party may assign or transfer any of its rights or obligations under this Agreement without the prior written consent of the other party, except as otherwise provided herein.

PRIVATE CLIENT ACCESS

All materials related to the grief support experience, including but not limited to tools, forms, schedules, documents, and resources, will be securely housed on the Mighty Networks Platform. Upon enrolling in the grief support experience, the Client will choose a unique username and password for access. The Client may access the platform at their convenience to view, review, and/or update records, documents, resources, and other materials related to the grief guidance experience. The Client will not update records, unless as instructed to do so in writing by the Grief Guide. Both the Grief Guide and Client acknowledge the importance of maintaining the confidentiality and security of the Client's login credentials and access to the platform. All materials on the platform remain the property of the Grief Guide.
